Dar says: "AAPL has 3 great inventions snaked computer world. Due to business decisions, it wasted previous two opportunities: 1. While Apple II made personal computer available for general public 2. Macintosh totally changed computing industry - from keyboard into mouse and icon. Jobs worked on its inventions but business was screwed up by John Scully. He fired Jobs. If AAPL agreed to licence Finder OS out, we won't have today's MSFT 3.
ReggieMiddleton says: "I like ARMH as well, but as you said... 80x+ trailing PE.
Dar says: "In my humble view, ARMH is a better bet and stock risk now is overall market tank. Even while US stock index tank, I still look ARMH for each bounce until underline business change. I love your comments on GOOG but think there is more for ARMH. My reason is that Android applications is exploding - Android monitor, Android TV, Android AIO, ... vast majority use ARMH core CPU. Even though now ARMH's trailing P/E is around 81. I love to see ARMH to be beaten a little while people give INTC high hope on its new CPU launch in June but this depends on market, not my hope. INTC loses to ARMH is ARMH simply falling into right business model at right time (planned or not I don't know). Why Android application will continue exploding? It is FREE plus competition makes ARM core CPU cheap. Let's take this example - GPS navigator: Traditionally, if you make a GPS navigator, you need to do hardware, firmware, and software. Now, you can download GPS software on a 7" cheap Android tablet which gives you much more. Why not buy a $99 or less 7" Android tablet and fix it in your car? Why buy a $150 GPS navigator? I love my free GPS software but even if you want to download a paid one, it still worthy far more. Soon, maybe car maker will put an Android tablet in every car to do all control plus entertainment, etc. Above is only one example. In past, if you buy CPU from INTC and Windows from MSFT, it is too expensive therefore people tend to use other CPU and do firmware/software themselves. Now, with cheap ARM core CPU plus free Android, a nice touch screen control panel can be added to many things. I might be wrong but I think that ARMH may benefit more than GOOG. Like INTC wrote PC hardware standard, ARM has written new standard on lots of systems, not limited to mobile. What I worry is that someday, ARMH decides to build chip itself rather than do purely IP licensing."

IrishJoe says: "Hi Reggie, amazingly scary and very diligent research! Can anybody predict how quick this will play out?
ReggieMiddleton says: " I thought of this as well. The key phrase is business as usual". In order to securitize, ex. MBS, they literally have to give the assets to a trust and relinquish ownership of the assets. That can be considered business as usual, but that also significantly weakens the charge. Even more to the point, charges that are all encompassing make it much easier for the ECB, et. al. to confiscate assets such as actual bank accounts."

Gabriel Donohoe says: ""I find it amazing that AIB is aware of information like this floating around and has not responded with a rebuttal." Failure to rebut is regarded as acquiescence or agreement in universal law and commerce, therefore AIB admits to its own criminality. Lack of government action in this matter testifies to collusion. "If the information is accurate, it literally shames the Irish banking regulatory body and press." Is this one of the reasons Elderfield resigned as Financial Regulator/Deputy Governor of Central Bank? Perhaps he sees an angry populace marching down the pike with pitchforks and lengths of neck-stretching rope. http://foolscrow.wordpress.com"

Mark Geoghegan says: "As for the irish authorities looking in to this and anything meaningful happening, I'm highly Skeptical. We had a ten year tribunal in this country called the Mahon tribunal. It found that our leader bertie ahearne and another fine fail politician patrick flynn were guilty of taking money. Flynn bough his wife a Farm from his ill got gains. Instead of jail these criminals got to retire on pensions that just boggle the mind. Five years on from the financial ruin not one banker or politician brought to justice. An bank bailout that our grand children will be paying for. And now those same banks have been giving the go ahead to start repossessing houses. They haven't even got the personal insolvency process in place. This is a very corrupt little country where no politician or bankers seem to be accountable for anything. Our national broad castor is basically a government propaganda unit. And our other broad castor(independ ant station tv3 is owned by tony oreilly who had interests in the corribb shell oil robbery and is the biggest share host in providence oil. So we can be sure we won't hear much about the corruption in this country fromi that source. Only for social media and programmes and Blogs like yours you have to go looking for the truth.
Pieter S says: "Dear Reggie, A million Germans signed a petition against the ECM. This monstrous treaty was created by Draghi, who was trained at Goldman Sachs for many years in paralyzing, avoiding and manipulating legislation. Our "ministers of finance" are in fact laymen, usually have not enough economic education. In the panic about the sovereign nations' debts they signed this treaty, which strips the nations of their democratic rights. The members of the ECM have no accountability to the governments of the union, are immune from prosecution and are bound to an oath of secrecy. The German Supreme Court considered the ECM unlawful and imposed restrictions on its independence but in it's new form it remains an bottomless pit and the European taxpayers are forced to contribute. Draghi turned on the money press in 2011 and 481 billion euro's were handed out to 523 European banks with no questions asked. Is the Irish chicanery not an incident but the beginning of common practice?"

Ian Clifford says: "Firstly the wrong regulator, the banks in the UK are now officially regulated by the Prudential Regulation Authority, part of the Bank of England, since they are responsible for micro and macro prudential regulation. The Financial Conduct Authority is responsible for consumer related matters, mis-selling etc.. Whilst I have agreed much of your thesis of the unsound nature of the Irish banking sector, I don't necessarily concur that Ulster Bank's Irish operations place RBS at systemic risk, more concerned about their investment bank. There have been significant write-downs at RBS already, after recently evaluating the major UK banks the PRA instructed the major banks (excluding HSBC I believe) to raise a further £25bn in capital. RBS is shrinking at a rapid rate and its no secret that it plans to IPO citizens as well as sell Coutts & Co as well as scaling back its international and investment banking operations. It has a good management team in place, Stephen Hester as CEO whilst taking a lot of criticism is doing a good job, and both the PRA and the UK Treasury are watching carefully, in theory at arms length through UKFI, but in practice on a tight rein. Love your work Reggie, just not sure on this one!"

Gemz says: "Reggie, you should know better than to tell the public about the activities of the US banks. Max Keiser puts the question that the Troika doesn't want a credit event. This is crucial - and is the key to understanding why taxpayers must bear the burden of banks that should be allowed to fail. It is the nature of a commercial organization to declare bankruptcy when it is insolvent. Only in this case, they can't because the US banks have too big a stake in this. I think you realize what the real problem is. If one of the US banks creates a credit event because it can't pay up on CDSs it is responsible for, the whole lot is doomed. That means credit events in Europe must be forestalled - and that means my taxes are paying for banks that should have been wrapped up years ago."

Jimmy Ryan says: "Reggie, Always enjoy your interviews with Max on Keiser Report. As I'm Irish, your last few articles and the latest interview on KR have been really interesting to me. I've been trying to explain to my Dad for at least a year now that the Irish banks along with many European and even global banks are hopelessly insolvent because of the huge fall in house/asset prices and their over-exposure to delinquent mortgages (in the Irish case especially). Here's my thinking at the moment and I'm wondering if someone here is of a similar belief/understanding as anyone I talk to about it here is clueless or living in ignorance. The Irish banks and the Government have been trying to avoid the issue of mortgage debt for years, it is only now coming to the fore. As a result of this, many of the banks' "assets" are grossly overvalued. Given the austerity the Government and the Troika are insisting on, more and more loans are bound to go delinquent leaving a huge black hole of losses to be filled by very little capital. I am led to believe that the Irish banks are leveraged on average 8 to 1 (similar to Cyprus but on a much larger scale) so when they do go under, and insured deposits are taken out of the equation (assuming that insurance is still in place when it happens) there will be almost nothing left to carve up between all other creditors. If the Troika is to insist on all creditors being made whole by the state, then it is highly likely the bailout will add billions upon billions onto the nation's already overburdened debt levels. This could put us in range of Japanese levels of debt to GDP if it was all dealt with at once. Pre-supposing that they cannot afford to deal with this all at once it is a lot more likely that they will half-ass this as normal and we get a smaller bailout to tide us by for a few years in the hopes that in the meantime the economy recovers and people become more able to pay their debts. The problem is, the added state interest payments will require more austerity and as a consequence more loan losses. Given that this is a situation likely to be replicated all over the Eurozone, as I believe you may be about to release in the coming days here, is it a fair deduction that Europe will be forced to endure continuous bailouts of zombie banks and nations on an ongoing basis? Is it also fair to say, that as long as all liquidity provided by central banks globally will be absorbed by the banks to take care of losses and avoid any large scale Lehman-like events, that the breaking point here will be when people cannot take the austerity anymore and the consequences are huge social unrest on a scale we haven't seen in decades? I'm still only 25 so I am open to a suggestion that my views are naive, as I have been told many times, but I would appreciate a critique from an expert with a greater understanding of the situation. Jimmy"

ReggieMiddleton says: " Two comments here. For one, I didn't mean to be offensive, and if I was I apologize. I'm a bold person, so I have no problem pushing offense if that was my intention, which it was not. I said these things would not fix themselves by magic, and Leprechauns are the magical figures from Ireland. It's as simple as that. Second, let's suppose you did find the comment offensive. Do you really mean to tell me that you let your largest banks mislead you as to their indebtedness and encumbrances after forcing the entire country into austerity through massive taxpayer funded bailouts and extreme debt placed upon you through Troika loans, yet you somehow fail to mention how that is not offensive, yet when I mention that financial problems don't right themselved by magic (whether they be leprechauns, fairies, unicorns, or other) you actually get your pants in a bunch? I probably risk offending you again (and I truly don't mean to, but apparently I simply can't help myself) but methinks maybe some of you may have your priorities askew. Just my humble opinion and said opinion is meant to be delivered with the utmost respect."

sinabhfuil says: "What a patronising sneer. If you'd written it straight, and left out all the 'leprechaun' codswallop, it might be readable. Incidentally, the Irish people didn't go to the troika looking for a 'bailout' - Irish politicians were forced to take enormous loans at crippling interest. There's no bailout here. There's an enforced debt, impossible to pay, which is wrecking society. People have forgotten, incidentally, that the Irish bank crash did not happen because of Irish borrowers paying for bubble-priced homes. It happened because Irish banks (principally Anglo-Irish Bank, now IBRC) made insane loans to developers and then laid these loans off against American sub-prime loans, which crashed."

Teresa says: "If only to give the dimwitted amongst us time to digest the figures and get our heads around it. I guess you're saying that a further bailout looks likely. Unemployment would soar and the economy would implode. Give us more time on this one. You want the SEC lobbied, right?"

Andy C20 says: " It's irrelevant what Target 2 is, my rude and obnoxious friend. The wording on the annual accounts is materially different from the wording on the charges - period!!! You seem to have a problem wrapping your less than polite head around that fact and concept, and it's plain on its face. Tell me, how many insolvent banks have you predicted the fail of? How many continental debt crises did you anticipate? Don't speak to me as if I'm a child, the problem here is clear and you've danced around if from the beginning. If other banks have similar actions, does it make the actions of this bank right? If three people robbed you, does that justify my robbing you. I will gradually release additional info on other banks that show less than translucent reporting to be the case, and if I'm wrong then I have no problem admitting it. You have to clearly point to me being wrong, though. Thus far, you've simply danced around the issue with invective."

ReggieMiddleton says: "I believe I've clarified the article satisfactorily. I believe AIB misrepresented the charge materially in its regulatory reporting. In addition, there are other issues that deserve further investigation, but the misrepresentati on is plain on its face. I actually got this clear, lay explanation from the site that you apparently came from: A more succinct description of the content of this post was actually found in the politics.ie forum. http://www.politics.ie/forum/economy/208732-accounting-issues-aib-4.html Originally Posted by Andycap After closer inspection, that article is gibberish. After closer inspection, you seem like quite the idiot. I don't see how it's gibberish: he's posted both documents he's talking about, and they do have different wording. Whether you can understand the article or not, that's fraud. And it's pretty serious fraud in the simplest of terms. Their annual accounts state the following — he has posted the image (it's the first document and the one with the AIB logo in the upper right-hand corner): On February 15th 2008, a first floating charge was placed in favour of the CBFSAI [Central Bank and Financial Services Authority of Ireland] over all Allied Irish Banks, p.l.c.'s right, title, interest and benefit, present and future, in and to certain segregated securities ("the Charged Property") listed in an Eligible Securities Schedule kept by Allied Irish Banks, p.l.c. for the purpose of participating... (Emphasis added by me.) The same wording is used in their files with the Securities and Exchange Commission in the United States. But then the charge document they filed with the Companies Registration Office (C.R.O.) says the following — he has also posted this image (it's the last image in the post): All right, title, interest and benefit, present and future, of the Company in and to each of the Eligible Securities from time to time, where "Eligible Securities" means, at any time, securities of such a class or description as may from time to time... (Emphasis added by me.) The trouble with this kind of fraud is that you need to know what all this stuff is about to recognise that it is pretty serious fraud. In their official 2008 annual accounts, they say "certain segregated securities", while in their official charge document with the C.R.O., they say "each of the Eligible Securities" (as in all of the eligible securities). Trust me on this, there is a huge difference between certain segregated securities and each of the Eligible Securities. Not only is it fraud under E.U. law, but given that the discrepancy in wording was also present in their filing with the S.E.C. in the U.S., you can bet that this minor "wording" change is a huge misrepresentati on, and outright fraud. These are the clever little sneaky things that the banks have been doing. They're so sneaky that it takes some forensic investigator like Reggie Middleton to find and spot them. I think everyone is expecting some kind of massive fraudulent activity that we can all understand — something that will fit in a headline — but this is as big as it gets. This wording change represents billions in profits. The reason it's fraud is because it grossly misrepresents the pledging of securities in the bank, and any investor who was buying shares or securities such as an American depository receipts (A.D.R.'s) on the U.S. markets would be looking very carefully at the S.E.C. filings to determine this kind of thing. He seems to be pushing for the S.E.C. in the U.S. to initiate proceedings against the banks, and I bet they will, too. He might not have explained it the best way, but to claim it's gibberish when he's got the documents to prove it is gibberish in itself."

Andy C20 says: " This is not a discussion Reggie. I have no idea what you are saying in your article. You're title implies AIB depositors are about to receive a haircut akin to what is happening in Cyprus. But the content of it relates to charges provided in support of particpation in a payment system and then jumps to ECB repurchase agreements. You are confusing charges provided to the Irish Central Bank with charges provided to the ECB, you seem to misunderstand the operation of a negative pledge clause, you are confusing the annual reports (2007 & 2008 when in fact they are 2006 & 2007) and as far as I can see there is no difference in the wording having looked on edgar."

ReggieMiddleton says: " I believe you're missing (or are ignoring) the point of the entire post. I allege that AIB has misrepresented their position in relation to charges given. You said they didn't. I then showed explicitly where they did, illustrating the stark difference between the wording in the charges and the wording in the annual accounts (the Irish version of the US annual report). The mere fact that we can have a conversation about the meanings implied proves my point, it is misleading. Ambiguous at best, fraudulent at its worst. There is no reason to go farther than this for that is the point of the entire article."

Andy C20 says: "Reggie, Perhaps I am missing something. I fail to see the charge discrepancy. Firstly we do not have the definition of Eligible Securities as governed by the Floating Charge so it is fair to say these Eligible Securities could be classified as certain segregated securities i.e. they are “certain” segregated securities because they relate only to Eligible Securities and do not include Non-Eligible Securities. Furthermore, while assets may be classed as Eligible Securities it does not mean they have actually been put into use as security. I really do not understand your reasoning here. Why are you providing links to charge documents relating to AIB's participation in a payment system and then discussing the ins and outs of its repo schemes? They would be two completely separate items. Perhaps you have other documents to hand but there is nothing posted above from which any conclusion could be made. B"

Pieter S says: "Dear Reggie, As soon as the most important parties in the market get a banking license, it is accompanied with an insurance against their own immoral, reckless and irresponsible activities. The safety net is donated to them for free by the government or the ECB, that's us. What about a free market? Let 's face it, there has never been a free market, the concept of a free market is theoretical. What about Greece, Portugal, Slovenia and Cyprus? If the Irish banks are saved (just to prevent their big fraudulent brothers in the States to fulfill their obligations) by double counting money and the IRCB-Target-NAMA shenanigan, don't the banks in the other countries have the right on the same treatment? And what about the people that bought CDS contracts? If the government really has swindled them for billions, they had better start a lawsuit!"

ReggieMiddleton says: "To further this conversation, Irish banks are considerably larger, and are in considerably more aggregate trouble than Cypriot banks. If Germany dissed the tiny Cypriot banks when additional aid was needed, what do you think will come of Irish bank depositors and bondholders??? http://www.zerohedge.com/sites/default/files/images/user5/imageroot/2012/05-2/Bridgewater%20Funding%20Gap_2.jpg This will likely get worse, because the Spanish banks have the EXACT same developer related problems that the Irish banks have. There isn't enough money in the pot to help Spain and/or Italy, even if Germany did cooperate. On that note, Germany is in recession and is a net exporter to nations who are in practical rescession or hard landing phase. What makes everybody think Germany can foot the bill, even if it wanted to???"

ReggieMiddleton says: " You are absolutely right. As a Yankee, silly oversights like this can be made, and I do apologize. I will address it directly in the post above. Thanks for the catch, and as you realize, this has very little to do with AIB's being healthy. I will add the correct charge momentarily...."

JPM says: "To follow on from my post above; it has occurred to me that perhaps the same lawyers were filing the same duplictious charges (as compared with the charges disclosed in the annual reports) on behalf of a number of their insolvent clients (relying on the nuanced cut and paste skills one learns in law school!!). If that is so, my above post stands corrected. While it's somewhat moot (given that the real issue is how likely it is that AIB will require further capital - very, given enough time and further, ahem, "credit crunches" (solvency blow-ups??)) , but perhaps, if you have a moment, you could clarify whehther that CRO filinig extract is in fact from a charge filed on behalf of allied Irish, not Anglo Irish? Thanks, and keep up the great work! J"

JPM says: "Reggie, First up, big fan of your work. One of the few people genuinely worth listening to these days. You have consistently had the quality dope on these dopes over these past few years. However, as an Irishman, I would draw your attention to one slight anomaly in the above post. It relates to the image containing the extracted explanation of AIB's Gross Settlement Systems from its annual report alongisde a page from a CRO charge filing. As far as I can see, the extracted page from the CRO charge filing actually relates to a charge filed by that other "AIB", Anglo Irish Bank, not Allied Irish. If you look at the name of the lawyer on the filing, it comes from the (former) lawyers for Anglo, Eugene F Collins, not Allied Irish Bank's lawyers. Correct me if I am wrong though. Notwithstanding that minor aberation, I wholehearetedly agree with your general thesis; Irish banks are a complete shambles, and the increasing German intransigence toward sharing some of the burden (for whcih many German banks were also responsibile) bodes ill for creditors of all colours, classes and stripes. Of course I hope it doesn't come to that for many friends of mine, but I fear you may (yet again) be on to something. Yours, An Irishman Watching On In Horror From Australia."

The Canadian Government Offers "Bail-In" Regime, Prepares For The Confiscation Of Bank Deposits To Bail Out Banks

Don from Canada says: "This does not seem to be a reminder to Canadian banks. This is new. See : The Office of the Superintendent of Financial Institutions Canada's recent press release... "OTTAWA –March 26, 2013 – Canada’s six largest banks have been identified as being of domestic systemic importance,... " their website is http://www.osfi-bsif.gc.ca The key point here is that some banks have grown so large and their various business dealings so interconnected with other banks that failure would have an extreme impact on the economy. I don't disagree that deposit insurance inherently injects moral hazard and that perhaps it should not exist at all. Depositors, being unsecured creditors, should hold the banks' management accountable. However, how can banks that have grown to such mammoth size that they need to be designated as systemically important... how can such banks be accurately assessed for risk by the depositor? How can the depositor follow and understand all the dealings that go on nationally and internationally and determine what the level of risk is to his or her deposit. This would be a monumental task. Most people have to work for a living and don't have the time to dedicate to this policing of their bank. Here is another interesting paper written by the FDIC and Bank of England... Title of paper: Resolving Globally Active, Systemically Important, Financial Institutions A joint paper by the Federal Deposit Insurance Corporation and the Bank of England 10 December 2012 http://www.bankofengland.co.uk/publications/Documents/news/2012/nr156.pdf Hint: the 'bail-in' term is used again. Couple this with what is happening in Cyprus and it's evident that we are witnessing a game changer."
